C4 MOBILE GAMING LLC

EVENT RENTAL AGREEMENT & TERMS OF SERVICE

By booking an event with C4 Mobile Gaming LLC (“C4”), the Client agrees to the following terms and conditions:

  1. PAYMENT TERMS
  • A 50% non-refundable deposit is required to reserve your event date and time.
  • The remaining balance is due 2 days prior to the event.
  • If booking is made within 3 days of the event, full payment is due at booking.
  • Failure to complete payment by the deadline may result in automatic cancellation of the reservation without refund of deposit.
  • Client expressly authorizes C4 to charge the payment method on file for any outstanding balance, including balances triggered by cancellation, no-show, or breach of this agreement.

 

  1. CANCELLATION POLICY (NON-NEGOTIABLE)
  • All payments are non-refundable.
  • If the Client cancels the event for any reason, all payments made are forfeited.
  • If cancellation occurs within 72 hours of the event, the Client remains responsible for the full remaining balance.
  • Client expressly authorizes C4 to charge the payment method on file for any remaining balance owed upon cancellation. Client waives the right to dispute or chargeback such charges with their financial institution.

 

  1. RESCHEDULING POLICY
  • One (1) reschedule is permitted if requested at least 7 days prior to the event and is subject to availability.
  • Rescheduled events must occur within 6 months of the original event date.
  • Rescheduling requests made within 7 days of the event may be denied or subject to a rescheduling fee at C4’s sole discretion.

 

  1. TRAVEL & SERVICE AREA
  • C4 services a base area within 20 miles of Suwanee, GA (30024).
  • Travel fees apply beyond this radius. The applicable travel fee for Client’s event has been disclosed in the booking confirmation, which is incorporated into this agreement by reference. Client acknowledges receipt of and agreement to such fees.
  • C4 reserves the right to decline events outside a reasonable service distance.

 

  1. WEATHER & SAFETY
  • The gaming trailer is climate-controlled and operates in most weather conditions.
  • Outdoor features may be limited due to weather.
  • C4 reserves the right to delay, modify, or reschedule services due to unsafe conditions including but not limited to severe weather. All weather-related determinations are made at the sole discretion of C4.
  • Weather-related modifications or rescheduling are subject to the same cancellation and rescheduling terms outlined in Sections 2 and 3. No refunds will be issued for weather-related service modifications.

 

  1. CLIENT RESPONSIBILITIES
  • The Client must provide a safe, accessible, and level parking area (minimum 40–50 feet in length) with adequate overhead clearance free of power lines, tree branches, or obstructions, and a firm surface capable of supporting the weight of the trailer.
  • C4 will not operate on unsafe, soft, muddy, or hazardous surfaces. If the site is deemed unsuitable upon arrival at C4’s sole discretion, the event may be cancelled and all payments forfeited.
  • Event time begins at the scheduled start time regardless of delays caused by the Client or site conditions.

 

  1. CHILD SUPERVISION
  • A parent or responsible adult must be present at all times during the event.
  • Children under the age of 6 must be supervised closely.
  • The Client must remain reachable throughout the event.
  • Failure to comply may result in termination of the event without refund.

 

  1. FOOD, DRINK, ALCOHOL & CONDUCT
  • No food or drinks are allowed inside the gaming trailer.
  • C4 reserves the right to stop or terminate the event if behavior is unsafe or disruptive.
  • Illegal drug use and alcohol consumption on or around the trailer are strictly prohibited.
  • If the event is terminated due to unsafe or prohibited behavior, no refunds will be issued and full payment remains due.

 

  1. DAMAGE POLICY
  • The Client is responsible for all damages caused by guests, invitees, or any person present at the event.
  • Prior to setup, a C4 representative will document the condition of the equipment. The Client acknowledges the pre-event condition and agrees that any damage identified post-event that was not pre-existing is the Client’s financial responsibility.
  • The Client authorizes C4 to charge the payment method on file for all reasonable repair or replacement costs resulting from damage to equipment or the trailer. Client waives the right to dispute or chargeback such damage charges with their financial institution.
  • C4 reserves the right to assess and document damage within 48 hours of the event and will provide written notice of any charges to the Client.

 

  1. LIABILITY WAIVER & INDEMNIFICATION
  • The Client acknowledges that participation in mobile gaming events involves inherent risks, including but not limited to: physical injury from entering or exiting the trailer, interaction with gaming equipment, tripping hazards inside or around the vehicle, and injury resulting from the actions of other participants.
  • The Client assumes full responsibility for all participants attending the event, including minors.
  • The Client agrees to release, indemnify, and hold harmless C4 Mobile Gaming LLC, its owners, employees, contractors, and affiliates from any and all claims, demands, damages, injuries, losses, or liabilities of any kind arising out of or related to the event, whether caused by negligence or otherwise.
  • THIS LIABILITY WAIVER IS A MATERIAL TERM OF THIS AGREEMENT. BY ACCEPTING THIS AGREEMENT, CLIENT KNOWINGLY AND VOLUNTARILY WAIVES LEGAL RIGHTS.

 

  1. MEDIA RELEASE
  • C4 may take photos or videos during events for marketing and promotional purposes.
  • By booking, the Client grants C4 permission for use of such content without compensation.
  • The Client may opt out by submitting a written opt-out request via email to C4’s designated contact email prior to the event. Verbal opt-outs will not be accepted. Opt-out must be confirmed in writing by C4 to be effective.

 

  1. VIDEO GAME CONTENT
  • “M” rated games will not be played without documented prior parental approval.
  • C4 reserves final discretion on game selection to ensure a safe and age-appropriate environment.

 

  1. RIGHT TO REFUSE SERVICE
  • C4 reserves the right to refuse, cancel, or terminate service at any time if conditions are deemed unsafe, inappropriate, or in violation of this agreement, with no refund obligation.

 

  1. FORCE MAJEURE

C4 shall not be held liable for failure to perform due to circumstances beyond its reasonable control, including but not limited to:

  • Vehicle breakdowns or mechanical failure
  • Extreme weather or natural disasters
  • Acts of God
  • Government restrictions, public health emergencies, or acts of civil authority
  • Technology or connectivity failures beyond C4’s control

In such cases, C4 will make commercially reasonable efforts to reschedule the event based on availability. No refunds will be issued for force majeure events. Rescheduling is subject to the terms of Section 3 and availability at C4’s sole discretion.

 

  1. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.

 

  1. DISPUTE RESOLUTION

Any dispute, claim, or controversy arising out of or relating to this Agreement, or the breach, termination, or validity thereof, shall be resolved exclusively by binding arbitration administered in Gwinnett County, Georgia, in accordance with the rules of the American Arbitration Association. The parties waive any right to a jury trial. Judgment upon the arbitration award may be entered in any court of competent jurisdiction. Notwithstanding the foregoing, C4 reserves the right to seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or business interests.

 

  1. AGE OF MAJORITY & AUTHORITY TO CONTRACT
  • Client represents and warrants that they are at least 18 years of age and legally authorized to enter into this binding agreement.
  • If Client is booking on behalf of an organization or third party, Client further represents that they have full authority to bind such organization to the terms of this agreement.

 

  1. ELECTRONIC SIGNATURE & ACCEPTANCE

This Agreement may be executed electronically. Client acknowledges and agrees that electronic acceptance of this Agreement — including clicking “I Agree,” submitting a deposit, or completing a booking — constitutes a valid and legally binding signature with the same force and effect as a handwritten signature, pursuant to the Georgia Electronic Records and Signatures Act (O.C.G.A. § 10-12-1 et seq.) and the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.).

 

  1. ENTIRE AGREEMENT

This Agreement constitutes the full and complete understanding between C4 and the Client and supersedes any and all prior discussions, representations, or agreements, whether oral or written. No modification of this Agreement shall be binding unless made in writing and signed by an authorized representative of C4.

 

 

ACKNOWLEDGMENT & ACCEPTANCE

By submitting a deposit or electronically booking an event, the Client acknowledges that they have read, understood, and agree to be legally bound by all terms and conditions set forth in this Agreement.
